KEADILAN DALAM KETENTUAN “DUA BANDING SATU ” HUKUM KEWARISAN ISLAM

Abstract

In the distribution of waris, justice is the foundation of humanity. This is the spirit shown by Islamic law. Without justice, the distribution of waris will cause conflict within the family. Various meanings are conveyed by experts regarding justice as the basis for the distribution of waris, especially in terms of two to one. Even so, the condition of the majority of Indonesian people is Muslim but not as an Islamic State, disputes often occur in interpreting justice. This is also the reason for the pullback in determining how to divide the waris. Not infrequently Muslims say the distribution of inheritance in Islam is unfair. So they gave a mandate to share waris to the district court. Even though justice in terms of language and terms has the context and purpose of its use. This article is a literature study by using a method of documentation about the fair meaning conveyed by experts and comparing it with the context of Indonesian Muslim society. Focusing on the literature review of justice is expected to provide new horizons in interpreting the fairness of understanding two to one in the distribution of waris.
