Abstract

Nowadays, many wives help earn a living for the family, even though in patriarchal culture, this work is usually considered the responsibility of men. This can give rise to legal problems of a wife providing maintenance to resolve the problem of discrimination against women. An-Naim provides the best offer in interpreting the propositions of the Qur'an and hadith as a new method of ijtihad according to today's times. This research aims to answer what is the formulation of the problem, namely what is the role of the wife as provider according to Indonesian marriage law and what is Abdullahil Ahmed lAn-Na'iml's view of a wife who plays the role of provider. This research is qualitative research using the library research method. All data used comes from published literature and is relevant to the topic of discussion. Especially from books by Abdullahi Ahmed An-Naim himself. In the legal context in Indonesia and the views of Abdullah Ahmed An-Na'im, wives are allowed to work and provide support if necessary. This is in accordance with the principle of equality in Islam and shows flexibility in legal interpretation to meet contemporary needs. This also reflects An-Na'im's emphasis on justice and equality, as well as the adaptation of Islamic law to modern realities.
